Should I feel flattered of violated?

Recently a new feature was added to Councilman Knode's web site). That feature was actually the video I shot of the Budget Committee meeting of 02/22/07. As that video was shot by me and originally appeared on The Overland Examiner it is copyrighted material. That particular video was poor in quality in my opinion (lens issue I believe). Also, Councilman Knode had his own camera setup at that meeting (but chose to use my video instead of his own). I guess I should be flattered.

I actually have no issue with Councilman Knode or anyone else using my material. As the Creative Commons License (in the footer section at the bottom of this web site) clearly states, people are free to use my material so long as they do not modify it, they attribute the work and they do not use it for commercial purposes. When using content from this site for non-commercial purposes all someone needs to do is reference that it originally came from John Moyle (or Overland Sailor) at The Overland Examiner and link back to the article it originally appear in (in this case: here). This was not done on Councilman Knode's site.

Originally I emailed and called Councilman Knode so we could correct this issue. I pointed out that all he needed to do to use that video on his site without violating my Copyright would be to attribute the work by adding that the video was copyright John Moyle of The Overland Examiner and provide a link to where it first appeared (here). However, considering the fact that Councilman Knode never calls me back when I call and he hasn't responded to email from me in months I decided to take a proactive approach to this violation of my rights. I pulled the video from Google video and re-posted it without the ability to embed it into a web site (as you might imagine, I have yet to hear from Councilman Knode on this issue). I still have no issue with Councilman Knode using that video if he would simply respect my copyright by attributing the work and linking back to where it originally appeared.

Councilman Knode's response to this situation is to post the following on his site in place of the video:

But the GOOGLE LINK to this previously uploaded video has been modified by complaining parties in order to prevent the viewing of the public February 22nd 2007 Budget Committee Meeting as previously available at this public link.

We continue to keep you informed.....

The above message, though it appears in the window the video previously appeared in on Councilman Knode's web site is not a message from Google. This statement completely mischaracterizes the situation as well. The public is not prevented from viewing this video (as it can be seen here). The change in hosting of the video is simply to prevent people like Councilman Knode for violating my Copyright and using the video without properly attributing it. For your review, the original article I wrote about the Budget Committee meeting of 02/22/07 where this video was originally linked can be seen here.

This appears to be yet another example of how little regard Councilman Knode and others have for the law and the rights of others. Something I certainly will remember on April 3rd.

Keep them honest ( for a change)and make them follow the rules. That's what we have been fighting for since April.

The situation is a bit frustrating to me. How hard is it to add a line letting people know where the video comes from and linking it back to article in question?

Example:

"This video was produced by John Moyle of the The Overland Examiner, and originally published as a link in this article."

A simple phone call or email to me and I would have gladly explained how to do this properly and even provided the HTML code if necessary.

This seems to be yet another example of how respecting the rights of the common man is a foreign concept to Councilman Knode.

Sailor,
I am glad you were able to stop Knode from using your video. The message he put in place of your video, leads people to believe it was removed because the opposing councilmen complained, because Knode hit a nerve with them (what rubbish). Why doesn’t Knode tell the truth, that he tried to steal your copyrighted material, and you prevented him from doing so? The ORT will be dishonest to the bitter end.

Steal is a bit of a harsh word. Its not inaccurate, but it is a bit strong. :-)

What Councilman Knode did was fail to follow the simple guidelines we have here for reposting / republishing content from this site.

If he contacts me in the future wanting to use this or other content, and agrees to follow our basic requirements, I have no problem with it.

However, based on past experiences I would be pleasantly surprised if Councilman Knode contacted me about this (or anything else). He never returns my calls or replies to my emails which is why we often cannot include his prospective in articles posted here.

I have yet to hear from Councilman Knode on this issue.

Yes, I live in Ward 1. However, I find it hard to refer to Councilman Knode as "my councilman" since he never returns calls, answers emails or addresses concerns when I, a resident of Ward 1, try to contact him.

I am hoping we will have another Councilman in Ward 1 who is actually interested in the needs and concerns of the residents of Ward 1 (rather than some guy in St. Charles) after April 3rd.

Well Sailor I watched the video and I have no idea why Knode would even attempt to use it. The video reflects him in his usual light, pompass, arrogant and very deceiving.

Councilman Knode went through my video, found bits and pieces that could be taken out of context to make his opposition look bad and then tried to direct people to those points with a posted time line.

For example (from his site):

"17:50 Mr. May is trapped into admitting that “TAX PAYERS PAY FOR EVERYTHING”..... thereby.... conceding the 30 plus years of TAX PAID TRASH SERVICES which he and his accomplices have repeatedly voted to discontinue, were in fact services that TAX PAYERS have paid for....
(* But of course, this is something YOU and I already knew, but yet something that Mr. May has repeatedly denied!!! )

So, Councilman May (why is it Councilman Knode never seems to use the proper titles when mentioning his political opposition?), said the Tax-Payers pay for everything. Wow, really a damning quote there. At least it is more honest then the "City Paid" trash service Councilman Knode and others keep pushing. To the best of my knowledge Council May had never denied that taxpayers paid for trash service (as the do for all other city services), he's simply stood by the facts that we no longer have the revenues to pay for it. Of course, propaganda, spin and misdirections are Councilman Knode's stock and trade.

What Councilman Knode and others refuse to consider is that though the City once paid for trash service the city's revenues are down. Less revenues means less money to pay for services. We got to the point that something had to give and so trash service was cut. This was a pretty fair service to cut when you consider that everyone in the city is equally effected (unlike many of the other services of the City).

Councilman Knode keeps playing these games, but he refuses to give any real information to the residents about his "City Paid" trash proposal. We keep asking Councilman Knode how $616,000.00 is going to pay for a service that currently costs between 1.2 and 1.3 million dollars. All we get in return are antics like what is quoted above and statements like we for some reason want to know what color the truck is. For the record sir, we want to know where the money is.

Councilman Knode: The people of Overland would like to have a serious discussion about your "City Paid" Trash service proposal. When can we expect you to get serious? Should we expect you to finally seriously address this issue at the Candidate Forum on March 14th?

That sounds like something Custer might have said as he was approachng Little Big Horn.

Just another example of the wanting it their way, violate a couple of laws in meantime no problem. Attribute anything of value to anyone either than themselves no way.

I'm sure you notified their ISP of the potential copyright infringement.

Oh Lordy. what happened to his "I am FOR THE PEOPLE" (please read with a Knode-type nasally twang)?
